Terms of Service

1. Acceptance of Terms

By accessing or using Fincards (the “App”, “Service”, or “Fincards”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our website, application, or services.
Your use of the App is also governed by Apple’s standard End User License Agreement (EULA). In the event of any conflict between these Terms and the Apple EULA with respect to your use of the App through the App Store, the Apple EULA shall prevail.

2. Service Description

Fincards is a provider of financial information, not a registered investment advisor, broker-dealer, or financial analyst. Content is for informational purposes only and does not constitute a solicitation, recommendation, or endorsement. The information we provide is believed to be reliable but is not guaranteed for accuracy or completeness. Nothing on Fincards constitutes financial advice or a recommendation to buy or sell securities. INVESTING INVOLVES RISK. PAST PERFORMANCE IS NO GUARANTEE OF FUTURE RESULTS. You should consult with a qualified professional before making any financial decisions.

3. Account Registration

To access certain features, you may be required to register and provide your email address. You agree to provide accurate information and to maintain the security of your account credentials. We maintain a comprehensive information security program in accordance with Massachusetts law to protect your personal information.

4. Subscriptions and Billing

4.1. Subscription Plans

Fincards offers monthly and annual subscription plans. By subscribing, you agree to the pricing and billing terms presented at the time of purchase.

4.2. Free Trials

If your subscription begins with a free trial (e.g., 1-week free trial for annual plans), you will be charged the subscription fee at the end of the trial period unless you cancel at least 24 hours before the trial ends.

All payments are processed through the Apple App Store. You must manage your subscription and request any refunds directly through your Apple ID settings. Fincards LLC does not have the authority to issue refunds for App Store transactions.

5. Use Restrictions

You may not reproduce, resell, or distribute any portion of Fincards, or use it to create competing products. Access is granted for your own internal, non-commercial use only.

6. Intellectual Property

All trademarks, logos, and content appearing on Fincards are owned by Fincards LLC. Unauthorized use is strictly prohibited.

7. DISCLAIMER OF WARRANTIES

THE SERVICE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FINCARDS LLC DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA PROVIDED (INCLUDING STOCK PRICES AND CHARTS) WILL BE ACCURATE, COMPLETE, OR TIMELY. FINCARDS LLC AND ITS AFFILIATES ARE NOT LIABLE FOR ANY DAMAGES RESULTING FROM THE USE OR INABILITY TO USE OUR SERVICE. FINCARDS RELIES ON THIRD-PARTY DATA PROVIDERS FOR MARKET DATA, INCLUDING STOCK PRICES, FINANCIAL STATEMENTS, AND OTHER INFORMATION. WE DO NOT INDEPENDENTLY VERIFY THIS DATA AND MAKE NO GUARANTEES REGARDING ITS TIMELINESS, SEQUENCE, ACCURACY, OR COMPLETENESS. WE ARE NOT LIABLE FOR ANY INTERRUPTIONS, DELAYS, OR ERRORS IN THIRD-PARTY DATA FEEDS.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINCARDS LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF THE SERVICE; (II) ANY ERRORS OR OMISSIONS IN ANY CONTENT; OR (III) ANY INVESTMENT DECISIONS MADE BASED ON THE INFORMATION PROVIDED.

9. User Obligations and Indemnification

You agree to use Fincards only for lawful purposes and in compliance with all applicable securities laws and regulations. You are solely responsible for any investment decisions you make. You agree to indemnify, defend, and hold harmless Fincards LLC and its affiliates from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Service.

10. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in Boston, Massachusetts, except that you may assert claims in small claims court if your claims qualify. You waive any right to participate in a class action lawsuit or class-wide arbitration.

11. Termination

We reserve the right to suspend or terminate your access to Fincards at our discretion, without notice, for conduct that violates these Terms or is otherwise harmful.

12. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict of law principles. Subject to the arbitration provision above, any disputes not subject to arbitration shall be subject to the exclusive jurisdiction of the state and federal courts located in Boston, Massachusetts.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the new Terms in the App, on our website, and/or through other communications, and updating the “Effective Date.” Your continued use of Fincards after such changes constitutes your acceptance of the updated Terms.
